ERI strongly believes that the ultimate success of our work depends on the extent to which it is disseminated. Without dissemination, it becomes another report that gathers dust on a shelf as opposed to an agent for positive change. In an effort to compliment our other dissemination methods, we have established this section of our Web site as a discussion vehicle for our current projects.

ADB Project for Improving the Legal Business Environment in the Pacific

In this discussion section of our Web site, we are facilitating debate around the legal problems that impact the business environment in the relevant countries. This part of the Web site includes functionality that allows for the posting of comments for the continuous exchange of views on the issues raised.

It is now widely recognized that having a strong and vigorous private sector is the only way for countries to achieve sustained growth that will eliminate poverty. In the Pacific Region, much attention has been paid recently to analyzing private sector development issues. The Asian Development Bank (ADB) has published the results of a number of investigations of the factors influencing the private sector in the Region. One of the findings of the private sector assessments (PSAs) completed for the ADB was that the commercial and legal framework for private sector development in the Pacific functions poorly. This resulting ADB technical assistance has gone on to analyze in detail the legal systems supporting commercial transactions for three countries -– Fiji, the Republic of the Marshall Islands and the Solomon Islands. The focus of the analysis was the degree to which the legal and commercial system supports arms length contracting, investment, and entrepreneurship.
